Terms & Conditions
Effective Date: April 21, 2025
These Terms & Conditions (“Terms”) govern all design services provided by Eber Marin (“Designer”) through Eber! Design for the Mental Health at ebermarin.com. By engaging in our services, you (“Client”) agree to the following terms:
1. Project Scope
The specific scope of each project will be defined and agreed upon before work begins.
Any changes or additions to the initial scope may require additional fees and adjustments to the delivery timeline.
Any requests beyond the original proposal will be considered out-of-scope and quoted separately.
2. Intellectual Property
All intellectual property rights of the final designs will be transferred to the Client after full payment is received.
The Designer guarantees that all original designs do not infringe on third-party copyrights.
The Client is responsible for providing all content, images, and materials with the appropriate usage rights.
3. Revisions & Approvals
A specific number of revisions will be included as outlined in the project agreement.
Additional revisions beyond the agreed number may incur additional charges.
Once the final design is approved, any further changes will be billed separately.
4. Deadlines & Delivery
A project timeline will be agreed upon prior to project commencement.
Timely delivery is dependent on the Client providing feedback and required assets on schedule.
A cancellation fee of 50% of the remaining project balance may apply if the project is canceled after initiation.
5. Payment & Billing
A non-refundable deposit of 50% of the total project cost is required before work begins unless otherwise agreed upon.
The remaining balance is due upon completion of the project and before final file delivery.
Printing, domain registration, and hosting services are not included unless specifically stated. Any third-party costs will be added to the final invoice.
Quotes are valid for 30 days from the date of issue.
6. Limitation of Liability
The Designer is not liable for any indirect, incidental, or consequential damages resulting from the use of delivered materials or services.
Total liability is limited to the total amount paid for the specific project in question.
7. Usage & Promotion Rights
The Client is granted the right to use the final designs exclusively for the agreed purposes.
Unless otherwise agreed upon in writing, the Designer retains the right to showcase the work in their portfolio, website, or promotional materials.
